This Privacy Policy (“Policy”) describes how ZNest Seniors, Inc. ( “Company”, “ZNest”, “we”, “us”, or “our”) we collect, use, and share in connection with the ZNest website at www.znest.com (the “Site”), and other software provided on or in connection with our services, as described in our Terms of Service (collectively, the “Service”). Using our Site and Service signifies your acceptance of the terms of this Privacy Policy and provide us with your consent to the collection and use of your personal information as detailed herein. If you find any part of this Privacy Policy disagreeable or unacceptable to you, you should immediately discontinue your use of the Service. Capitalized terms used herein without definition shall have the meanings assigned to them in the Terms of Service.

Collection of your Personal Information

Information You Give Us. “Personal Data” or user contact data means data that allows someone to identify you individually, including, for example, your name, email address, as well as any other non-public information about you that is associated with or linked to any of the foregoing. Personal Data includes user demographic data including gender/identifier, age, date of birth, race, etc. “Anonymous Data” means data, including aggregated and de-identified data, that is not associated with or linked to your Personal Data; Anonymous Data does not, by itself, permit the identification of individual persons. We collect Personal Data and Anonymous Data as described below. We may collect Personal Data such from your resident application as requested by the Facility Provider, which may become associated with Personal Data when you use our Service. We may also collect Personal Data at other points in our Service where you voluntarily provide it or where we state that Personal Data is being collected. We may also collect Anonymous Data.

Information Automatically Collected. We may automatically collect information about your computer hardware and software as you navigate through and interact with our Service. We may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

  1. To provide our Service and make it more useful to you, we (or a third-party service provider) collect information from you, including, but not limited to, Internet Protocol (“IP”)/device information (e.g., IP address, device ID, domain server, type of device/operating system/browser used to access the Service, etc.), web analytics (e.g., web page interactions, referring webpage/source, non-identifiable request IDs, statistics associated with the interaction between device or browser and the Service, etc.), and geolocation data (e.g., IP address-based location information, etc.).

This information includes IP addresses, browser type, Internet service provider (“ISP”), referring/exit pages, operating system, date/time stamps, and clickstream data. We use this information to analyze trends, administer the Service, track users’ movements around the Service, and better tailor our Services to our users’ needs. For example, some of the information may be collected so that when you visit the Service, it will recognize you and the information can be used to personalize your experience.

  5. How We Respond to Do Not Track Signals. Our systems do not currently recognize “do not track” signals or other mechanisms that might enable Users to opt out of tracking on our site.
  6. In addition to the tracking technologies we place like Cookies and Pixel Tags, other companies may set their own cookies or similar tools when you visit our Service. This includes third-party analytics services (“Analytics Services”) that we engage to help analyze how users use the Service. The information generated by the Cookies or other technologies about your use of our Service (the “Analytics Information”) is transmitted to the Analytics Services. The Analytics Services use Analytics Information to compile reports on user activity, which we may receive on an individual or aggregate basis. We use the information we get from Analytics Services to improve our Service. HIPAA and PHI

Certain demographic, health and/or health-related information that ZNest collects from you as part of providing the Services to our Facility Providers may be “protected health information” or “PHI” and governed by the Health Insurance Portability and Accountability Act and its implementing regulations (“HIPAA”). Specifically, when (i) ZNest is providing administrative, operational and other services to a Health Care Provider and this Healthcare Provider is a “Covered Entity” (as such term is defined in HIPAA); and (ii) in order to provide those services, ZNest receives identifiable information about a user on behalf of the Healthcare Provider, ZNest is acting as a “Business Associate” (as such term is defined in HIPAA) of the Health Care Provider, and this identifiable information is regulated as PHI.

HIPAA provides specific protections for the privacy and security of PHI and restricts how PHI is used and disclosed. Please read the notice of privacy practices of your Facility Provider to understand how your PHI can be used and disclosed.

HIPAA does not apply to Personal Data (defined below) that is not PHI. Personal data that a User provides to ZNest when ZNest is not acting as a Business Associate is not PHI. A few examples include when you (i) create an account, (ii) search for Facility Providers or available openings with Facility Providers, (iii) complete general medical history forms that are not required by or provided by a particular Facility Provider (“General Medical History Forms”); (iv) post reviews; or (v) provide device/IP Information or Web Analytics information by browsing our websites (see below).

Use of Cookies & Similar Technologies

We use a variety of technologies to help us to deliver customized visitor experiences. We use Google analytics to collect information about your interaction with our website. Under California Civil Code Section 1798.83, California customers are entitled to request information relating to whether a business has disclosed Personal Information to any third parties for the third parties’ direct marketing purposes. We do not sell or share your Personal Data with third-party companies for their direct marketing purposes without your consent.

Children’s Privacy

We do not knowingly collect personally identifiable information from children under the age of thirteen. If you are under the age of thirteen, you must ask your parent or guardian for permission to use this website.

Automatic Telephone Dialing System

By providing us with your telephone number, including on our Sites or over the telephone, you agree to be contacted by ZNest and contracted senior care network providers to explore options relating to our Services. You agree to be contacted by telephone call or text message at the telephone number you provided using automatic telephone dialing systems, even if you previously registered on a Do Not Call registry, and consent is not a condition of any purchase.

Opt-Out & Unsubscribe

We respect your privacy and give you an opportunity to opt-out of receiving announcements of certain information. Our marketing emails tell you how to “opt-out.” If you opt out, we may still send you non-marketing emails. Non-marketing emails include emails about your accounts and our business dealings with you.
